Welcome to nuPodder! These Terms of Service ("Terms") govern your use of the nuPodder website, mobile applications, API, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

nuPodder provides a directory, synchronization service, and API for podcast listening and discovery. We do not host the audio files of the podcasts listed in our directory; we provide links to content hosted by third-party publishers.

2. User Accounts

• Account Creation: You must create an account to use certain features of the service. You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.
• Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the site.
• Termination: We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service if you provide any information that is untrue, inaccurate, not current, or incomplete.

3. API and Developer Usage

If you access or use the nuPodder API ("API"), the following additional terms apply:

• License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the API solely to develop, test, and support your integration with nuPodder.
• Rate Limits: You agree to comply with all rate limits and usage restrictions outlined in our API documentation.
• Abuse: You shall not use the API in any manner that constitutes network abuse, attempts to circumvent rate limits, or harms the nuPodder infrastructure. We reserve the right to revoke API keys at any time for any reason.

4. Intellectual Property and Open Source

The source code for the nuPodder platform is open source and made available under the BSD 3-Clause License. You are free to view, use, modify, and distribute the source code in accordance with the terms of that license.

However, the nuPodder name, logos, domain names, and other distinctive brand features are the exclusive property of nuPodder and are protected by trademark laws. Your use of the Service does not grant you any right to use our trademarks, nor does it grant you ownership over the specific infrastructure and databases we use to host the Service. Additionally, third-party podcast audio and user-provided content remain the exclusive property of their respective owners.

5. Third-Party Content

Our service acts as a directory and may contain links to third-party websites, audio files, or services that are not owned or controlled by nuPodder. nuPodder has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

6. Limitation of Liability

In no event shall nuPodder, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Tennessee, United States of America, without regard to its conflict of law provisions.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
